The State Department projects little or no forward movement in the employment-based priority dates for the remainder of the fiscal year which ends on September 30, 2024.  The worldwide EB-2 and EB-3 categories are expected to retrogress in August 2024.

The USCIS has determined that in July 2024, applicants in all family-sponsored preference categories must use the Dates for Filing Chart and all employment-based preference categories must use the Final Action Dates Chart when applying for adjustment of status.

 
 

There is forward movement in some of the employment-based categories in July:

The EB-1 category worldwide remains current while EB-1 China moves forward by 2 months and EB-1 India advances 11 months.

The EB-2 category worldwide and for India both advance by 2 months while EB-2 China moves forward by 1 month.

The bad news is that EB-3 worldwide retrogresses almost 1 year and EB-3 China remains frozen. However, EB-3 India advances by 1 month.

EB-4 for all countries moves forward by 2 months.

EB-5 worldwide remains current while EB-5 Unreserved for China and India remains frozen.

 
There is forward movement in most of the family-based categories in July:

The F-1 category worldwide moves forward by 3 1/2 months.   F-1 for Mexico advances by over 4 months. F-1 for the Philippines remains frozen.

The F-2A category for nationals of all countries remains frozen.

The F-2B category worldwide advances 1 month while F-2B for Mexico and the Philippines remains frozen.

The F-3 category worldwide advances by 1 month. For nationals of the Philippines, it moves forward by 2 weeks. For Mexico, F-3 advances by 3 months.

The F-4 category worldwide advances by 1 week as does F-4 for India and Mexico.  F-4 Philippines moves forward by 2 months.

EMPLOYMENT-BASED CATEGORIES

 

The employment-based (EB) categories in the Visa Bulletin are as follows:

An applicant’s priority date is the day that the government receives the employer’s PERM application. If a PERM application is not required, the priority date is the date the government receives an EB visa petition (Form I-140 or Form I-526).

FAMILY CATEGORIES

The family-based categories in the visa bulletin are as follows:

An applicant’s priority date is the day that the government receives the I-130 Petition. Watch our family-based video to see various methods of shortening your waiting time for a green card.

The word “Current” in the Visa Bulletin indicates that no backlog presently exists in a particular category. Alternately, “U” or the word “Unavailable” indicates that it is not possible to apply for permanent residence in that category.

B. FAMILY-SPONSORED FILING DATE CHART – The chart below reflects dates for filing visa applications within a time frame justifying immediate action in the application process. Applicants for immigrant visas who have a priority date earlier than the application date in the chart may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions.

The application date for an oversubscribed category is the priority date of the first applicant who cannot submit documentation to the National Visa Center for an immigrant visa.
